Terms of Service

1. Agreement to Terms

By creating a Hypee account or using any part of our platform at hypee.in, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Hypee.

These Terms form a legally binding agreement between you and Hypee ("we," "us," "our"). Our platform operates under Indian law. If you are using Hypee on behalf of a business or brand, you represent that you have authority to bind that business to these Terms.

2. What Hypee Is

Hypee is a creator business platform that provides:

• Creator Marketplace: Connecting Instagram creators with brands for collaboration opportunities
• Media Kit Generator: Creating and sharing professional creator media kits
• Brand Campaigns: Brands post campaigns; creators apply directly
• Lead CRM: Managing and organizing leads and brand contacts
• Analytics: Tracking kit views and platform performance
• Instagram DM Automation (Coming Soon): Automatically sending Direct Messages to users who comment on your posts — launching once we receive Meta API approval

3. Eligibility

To use Hypee, you must:

• Be at least 18 years old
• Have a valid Instagram Business or Creator account (for creator features)
• Agree to Instagram's Terms of Use and Meta's Platform Terms
• Agree to these Terms and our Privacy Policy
• Be located in a country where Instagram is legally accessible
• Not be prohibited from using our services under applicable law

4. Your Account

4.1 Account Creation

You must provide accurate, complete information when creating your account. Do not impersonate anyone or create accounts on behalf of others without authorization.

4.2 Account Security

You are responsible for keeping your password secure, all activity that occurs under your account, and notifying us immediately at support@hypee.in if your account is compromised.

4.3 One Account Per User

Each person may have one creator account. Brands may have one brand account. Using multiple accounts to circumvent plan limits is prohibited.

5. Instagram Integration and Meta Platform Rules

5.1 You Authorize Hypee to:

• Read comments on posts you configure for automation
• Send Direct Messages on your behalf when your automation triggers
• Read your Instagram profile data to populate your Hypee profile
• Display your public stats in our creator marketplace (you can opt out)

5.2 You Are Responsible for:

• Ensuring all DM messages you write comply with Instagram's Community Guidelines
• Ensuring your automation does not harass, spam, or mislead other users
• The content of all automated DMs sent from your account
• Complying with Meta's Platform Terms at all times

5.3 Prohibited Instagram Uses on Hypee:

You may NOT use Hypee to:

• Send DMs containing misleading, deceptive, or false information
• Send DMs that constitute spam as defined by Instagram's policies
• Automate DMs to minors without appropriate consent
• Promote illegal products, services, or activities in DMs
• Use automation to harass, threaten, or abuse other users
• Attempt to scrape data from Instagram profiles
• Automate following, unfollowing, liking, or commenting (Hypee does not support this)
• Violate any of Meta's Platform Terms or Instagram's Terms of Use
• Send messages at a rate that violates Meta's rate limits

5.4 Meta Platform Compliance

Hypee uses the official Meta Graph API and complies with Meta's Platform Terms, Instagram's Platform Policy, Meta's Business Tools Terms, and Instagram's Community Guidelines. If Meta changes their policies, some features may stop working. This does not entitle you to a refund.

5.5 Account Safety (when automation launches)

Hypee will implement smart delays (5–30 seconds between DMs), hourly DM limits (190/hour, within Meta's 200/hour cap), automatic pause on error spikes, and deduplication (no repeat DMs within 24 hours). These are protections, but we cannot guarantee your Instagram account will never be flagged by Meta. You use DM automation at your own risk. Hypee is not responsible for any actions Meta takes on your Instagram account.

6. Creator Marketplace Terms

6.1 For Creators

• Your public Instagram stats are shown to brand accounts
• You control what rates and information appear on your profile
• You can opt out of marketplace listing at any time in Settings
• Being listed does not guarantee you will receive brand deals

6.2 For Brands

• Creator stats are pulled from official Instagram API data and may have a delay
• Engagement rates are calculated estimates
• Hypee does not guarantee the accuracy of creator's self-reported information
• Hypee is not a party to any deal between brands and creators
• Payment between brands and creators happens outside Hypee

6.3 Brand-Creator Deals

Hypee facilitates connections. We are not responsible for deals that fall through, content quality, payment disputes, or campaign results. Both parties are responsible for their own agreements, contracts, and tax obligations.

7. Acceptable Use

You agree NOT to use Hypee to:

• Violate any applicable law or regulation
• Infringe on any person's intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to Hypee's systems
• Reverse-engineer, decompile, or disassemble any part of Hypee
• Use automated scripts or bots to access Hypee (except as authorized)
• Misrepresent your identity or affiliation
• Engage in any activity that disrupts or interferes with the platform
• Use Hypee to promote hate speech, discrimination, or violence
• Use Hypee in any way that could damage our reputation or relationship with Meta

8. Content You Create

8.1 Your Content

You own all content you create on Hypee (DM messages, media kit content, notes). By creating content on Hypee, you grant us a limited license to store, display, and use that content to provide our services to you.

8.2 Content Standards

All content you create must comply with Indian law, not infringe on any third party's rights, not contain false or misleading information, and not violate Instagram's Community Guidelines. We reserve the right to remove content that violates these standards.

9. Subscription Plans and Payments

9.1 Plans

• Free Plan (Creator): ₹0/month — marketplace listing, 1 media kit, leads CRM
• Creator Pro: ₹999/month — priority listing, full analytics, unlimited leads, DM automation when live
• Free Plan (Brand): ₹0/month — browse creators, post 1 campaign/month
• Brand Pro: ₹2,999/month — unlimited campaigns, advanced filters, analytics, team access

We reserve the right to change plan features or pricing with 30 days notice to existing subscribers.

9.2 Billing

• Subscriptions billed monthly in Indian Rupees (₹)
• Payments processed by Razorpay (UPI, cards, net banking)
• Subscription auto-renews on the same date each month

9.3 Refund Policy

• No refunds for partial months
• If you cancel, you retain access until end of current billing period
• Technical billing errors: contact support@hypee.in within 7 days for a full refund
• Chargebacks filed without contacting us may result in account suspension

9.4 Cancellation

Cancel anytime from Settings → Billing → Cancel Subscription. Access continues until end of current billing period, then downgraded to Free plan.

10. Intellectual Property

10.1 Hypee's IP

The Hypee name, logo, website design, software, and all content we create is our intellectual property. You may not copy, reproduce, or use it without written permission.

10.2 Your IP

You retain all rights to content you create. We do not claim ownership of your content.

10.3 Feedback

If you provide feedback or suggestions about Hypee, you grant us the right to use that feedback without compensation.

11. Disclaimers and Limitations

11.1 "As Is" Service

Hypee is provided "as is" without warranties of any kind. We do not guarantee 100% uptime, that automations will always work, that you will receive brand deals, or that DM automations will never result in any action by Meta on your account.

11.2 Limitation of Liability

To the maximum extent permitted by Indian law, Hypee's total liability for any claim shall not exceed the amount you paid us in the 3 months before the incident. We are not liable for any action taken by Meta/Instagram on your account, lost profits, data loss, or indirect damages.

12. Termination

12.1 Your Right to Terminate

You may delete your account at any time from Settings → Account → Delete Account.

12.2 Our Right to Terminate

We may suspend or terminate your account immediately if: you violate these Terms, you violate Meta's Platform Terms, your use puts other users at risk, we are required to by law, or your payment fails and is not resolved within 7 days.

12.3 Effect of Termination

Upon termination, your access stops immediately, all active automations stop, your Instagram token is revoked, and your data is deleted per our Privacy Policy timeline.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in India. Before filing any legal claim, you agree to contact us at support@hypee.in and attempt to resolve the dispute informally for 30 days.

14. Changes to Terms

We may update these Terms. When we do, we update the "Last Updated" date. For material changes, we email you 30 days in advance. Continued use after changes constitutes acceptance.
